Seminar on International Trade Law
The tenth anniversaries of Taiwan and China’s Participation in WTO

Description and Requirements:
1. The course will be conducted in English.
2. Since both Taiwan and China have participated in the WTO for almost 10 years, it is an appropriate time to review their participations and respective roles in the WTO.
3. The following topics will be the focus of our discussions:
(1) China’s expanding economic influence and its role in international economic relations;
(2) China’s attitude toward and strategy in the negotiations and dispute settlement of WTO;
(3) The role played by Taiwan as a relatively small economy under the WTO;
(4) Dispute settlement cases with China or Taiwan as a complainant or a respondent.
The case numbers are listed below.
China as complainant — 7 cases:
DS252, DS368, DS379, DS392, DS397, DS399, DS405
China as respondent — 21 cases:
DS309, DS339, DS340, DS342, DS358, DS359, DS362, DS363, DS372, DS373, DS378, DS387, DS388, DS390, DS394, DS395, DS398, DS407, DS413, DS414, DS419

Chinese Taipei as complainant — 3 case(s):
DS274, DS318, DS377
Chinese Taipei as respondent — 0
4. Some of cases might not have gone to panel stage. Some of them only have panel reports. Some others have AB report or even arbitration report. Each student is expected to select a case to report to the class. It is preferred for students to select the disputes with at least a panel report. The contents of the dispute can be found at the WTO official website at http://www.wto.org/english/tratop_e/dispu_e/dispu_by_country_e.htm. After the first meeting of our class, students are to inform the instructor about the case he/she selects. Then there will be a compilation of the case names to be circulated to the students. Students will be responsible for downloading the materials by themselves and bring a hard copy or the laptop to the class each time. They will also need to bring the texts of the WTO agreements to the class for constant references.
5. Each student will be responsible for a dispute settlement case he/she selects and is to (1) Report to the class about the factual background; (2) Report to the class about the stages and current status of the dispute; (3) Identify the important issues involved in the dispute; (4) Lead the discussions on each of these issues.
6. All participants need to come to the class each and every time with good preparations. In no event, the participants should miss two or more classes without good reason. Discussions in the classes are very important for their final evaluation.
